Richard Stephenson’s diverse litigation practice includes employment and administrative law, commercial litigation, and class actions. Richard has a particular area of expertise in energy law, having acted at the Ontario Energy Board for much of his career. Richard is esteemed by his peers, who often consult with him on their most difficult legal challenges.

Richard speaks and teaches widely, having served as an instructor at the Osgoode Hall Law School Intensive Trial Advocacy Program, and a regular contributor to the continuing legal education programs of the Law Society, Advocates’ Society and the Ontario Bar Association. Representative Work

  • Richard Stephenson, Emily Lawrence and Douglas Montgomery represented a trade union in a complex arbitration involving drug and alcohol testing in nuclear facilities, and in a related constitutional challenge in Federal Court to a regulatory instrument imposing drug and alcohol testing in nuclear facilities. Richard, Emily and Douglas obtained interim stays from the arbitrator and the Federal Court of the implementation of drug and alcohol testing in nuclear facilities, pending final disposition (2022 FC 73).

  • Counsel for one of the accused in R. v. Nugent in Ontario Court of Appeal. The case is the leading authority in Ontario on the application of s. 11 (b) of the Charter of Rights and Freedoms in prosecutions under the Occupational Health and Safety Act.

  • Is senior practitioner in the electricity regulation field and appears regularly before the Ontario Energy Board and Canadian Nuclear Safety Commission.

  • Appeared as counsel in the Supreme Court of Canada in OEB v. OPG and Bell Canada v. Bell Aliant, two of the leading authorities on Canadian rate regulation.

  • Was a Commissioner on the 7th and 8th Justices of the Peace Remuneration Commissions.

  • Richard has spoken on numerous occasions to groups regarding developments in the electricity sector in Ontario. He has frequently served as an instructor in a variety of advocacy skills programs, including the Osgoode Intensive Trial Advocacy Program.
